Please read carefully. These Terms govern your use of the Zephyr's Elixir software and its Pro version. The free app is open-source software (Apache 2.0 license); the Pro version is a proprietary paid module. Purchase is made through Whop, which acts as the seller. By using the software you accept these Terms.

1. Definitions

Software / Application
The "Zephyr's Elixir" desktop program for Windows, in its free open-source version.
Pro version / Pro module
The proprietary add-on (a signed, encrypted DLL) that enables advanced features, downloaded and loaded at runtime upon a valid license.
Open Core
The distribution model: an open core (Apache 2.0) plus closed-source Pro extensions.
License
The personal, non-exclusive right to use the Software and โ€” if purchased โ€” the Pro version under these Terms.
Whop
The whop.com platform (Whop Inc.), acting as merchant of record (seller), handling payment and issuing the license key.
ADB
Android Debug Bridge, the official Android protocol through which the Software operates on the connected device.
ZephyrsAgent
An auxiliary component (APK) installed on the connected Android device to enumerate installed apps.
Provider
blast752 (Italy), author of the Software and licensor of the Pro features.
User
The natural person who downloads, installs or uses the Software.

2. Nature of the license

2.1 Free core (open source)

The free Application is released under the Apache License 2.0, whose text governs use, modification and redistribution of the source code, available on the public repository github.com/blast752/zephyrs-elixir. The Software is provided "as is" under that license.

2.2 Pro version (proprietary)

The Pro module is closed-source proprietary software, NOT covered by the open-source license. Your purchase grants a personal, non-exclusive, non-transferable (to third parties) and revocable license, valid for one (1) device at a time. The license may be moved to another device after deactivating the previous one (Settings โ†’ License โ†’ Deactivate).

The license is validated online periodically and works offline for up to 7 days. The Pro module is bound to your device identifier and encrypted; it remains the Provider's property.

3. Purchasing the Pro version via Whop

The Pro version is purchased exclusively through Whop. Clicking the purchase buttons redirects you to the Whop platform, where the sale contract and payment are concluded; Whop then generates the license key that the website and Application read and validate through Whop's official APIs.

  • Seller: Whop acts as merchant of record. The purchase contract and the receipt/invoice are with Whop, under Whop's Terms of Service and privacy policy, which you accept at checkout.
  • Plans: Monthly or Annual subscription, at the prices shown on the purchase page (authoritative and prevailing in case of discrepancy).
  • Payment methods (handled by Whop): cards, PayPal, Apple/Google Pay and crypto.
  • Delivery: after payment you receive the key by email; activation is done in Settings โ†’ License in the app.

The Provider does not store or directly process your card or payment-instrument data, which is handled entirely by Whop and its processors.

4. Permitted use & prohibitions

You agree to use the Software lawfully and under these Terms. In particular, you must not:

  • reverse engineer, decompile or disassemble the Pro module, or circumvent, remove or alter the technical protection, encryption, signing or license-verification measures, except to the extent mandatorily permitted by law;
  • share, resell, sub-license, rent or distribute the license key or the Pro module to third parties;
  • use the Pro version on more than one device in breach of the "1 device" rule, or attempt to circumvent that limit or the validation checks;
  • use the Software to operate on devices you do not own or are not authorised to manage, or for unlawful purposes or purposes harmful to third parties;
  • remove copyright or attribution notices.

Use of the open-source core also remains subject to the Apache 2.0 license (ยง2.1), which prevails for the code it covers.

5. Risks of use & user responsibility

Advanced tool. Zephyr's Elixir performs powerful operations on the Android device over ADB: uninstalling/disabling apps (including system apps), changing system settings, "Extreme Mode", privacy actions (e.g. Safety Core, RAM expansion). Such operations may impair device functionality, cause data loss or, when removing critical components, render the device unusable ("brick").

You acknowledge and accept that:

  • you act at your own risk and are solely responsible for the actions performed and the apps selected for removal/modification;
  • the AI risk analysis is purely informational and advisory and does not replace your own judgement; the final decision is always yours;
  • it is strongly recommended to back up your data and APKs before operating;
  • installing the ZephyrsAgent component on the device is required for some features and occurs under your control.

6. Warranties & disclaimer

The Software (free core) is provided "AS IS" and "as available", without warranties of any kind to the maximum extent permitted by the Apache 2.0 license and applicable law.

For the Pro version purchased by consumers, the mandatory legal conformity guarantees remain unaffected (EU consumer law and Dir. (EU) 2019/770 on digital content and services). However, to the extent permitted by law:

  • we do not warrant that the Software is error-free or always available, nor that optimisations will produce a specific result on every device, given the diversity of brands, models and Android versions;
  • features that depend on AI rely on a third-party service (OpenAI): the output is provided "AS IS", without warranty of accuracy, completeness or fitness for a particular purpose;
  • we are not responsible for the operation of third-party services (Whop, OpenAI, GitHub, scrcpy) or changes they make.

7. Limitation of liability

To the maximum extent permitted by law, the Provider is not liable for indirect, incidental or consequential damages, nor for loss of data or damage to devices arising from use of the Software, subject to the following.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including cases of intent or gross negligence, personal injury, and the mandatory rights granted to consumers.

Where liability exists and may be limited, it is in any case capped at the amount you actually paid for the license in the 12 months preceding the event. For the free core, provided at no charge, the limitation in the Apache 2.0 license applies.

8. Right of withdrawal & refund policy

If you act as a consumer, you have the right to withdraw from the purchase contract within 14 days without giving reasons (Dir. 2011/83/EU, as implemented in your country; for Italy, Arts. 52 ff. of the Consumer Code).

Digital content & immediate performance. The Pro version is "digital content not supplied on a tangible medium". On activating/downloading the Pro module you expressly request immediate performance of the supply and acknowledge that you lose the right of withdrawal once performance has begun with your consent (Art. 16(m) Dir. 2011/83/EU; for Italy, Art. 59(1)(o) Consumer Code). Accordingly, an already-activated license is not refundable as of right.

8.1 Voluntary satisfaction guarantee

In addition to your statutory rights, and to protect good-faith users without encouraging abuse, we voluntarily offer a refund where:

  • the license has not yet been activated and the request is received within 14 days of purchase; or
  • there is a technical defect attributable to the Software that, once reported to support, is not resolved within a reasonable time.

Withdrawal/refund requests should be sent to zephyrselixir@gmail.com and, as the purchase is made through Whop, are processed under Whop's procedures. To exercise withdrawal (where applicable) you may use an explicit statement or the model form provided by applicable consumer law.

9. Software updates & changes to the terms

For security and compatibility reasons, the Software checks for updates at startup. Outdated versions may stop working or require updating to continue use: this serves to protect users and the integrity of the licensing system.

We may modify the Software, the features (including the Free/Pro feature set) and these Terms. For significant changes we will give notice on the website and/or in the app; continued use after notice constitutes acceptance. Your right to cancel the subscription where changes are unfavourable to you remains unaffected.

10. Dispute resolution & jurisdiction

We invite you to contact us at zephyrselixir@gmail.com to resolve any dispute amicably.

Alternative dispute resolution (ADR). As a consumer you may turn to alternative dispute resolution bodies under Dir. 2013/11/EU (in Italy, implemented by Legislative Decree 130/2015). Note that the European Commission's ODR platform was discontinued on 20 July 2025 and is no longer available; national ADR bodies remain operational.

Jurisdiction. For disputes with a consumer, the courts of the consumer's place of residence or domicile have exclusive, non-derogable jurisdiction (for Italy, Art. 66-bis Consumer Code). For non-consumer users, the courts of the Provider's place of establishment have jurisdiction.

11. Governing law

These Terms are governed by Italian law. If you are a consumer resident in the EU, you remain protected by the mandatory provisions of your country of habitual residence that cannot be derogated from by contract (Art. 6 Reg. (EU) 593/2008 โ€” "Rome I"). For the source code of the free core, the Apache 2.0 license prevails.

By using Zephyr's Elixir or purchasing the Pro version, you acknowledge that you have read, understood and accepted these Terms & Conditions.
